As of May 2016, the Tobacco Products Directive (TPD) requires mandatory notification for marketing tobacco products containing nicotine in Europe. Every product declared must notify:
- the recipe detailing the various molecules in the composition exceeding a concentration of 0.1%,
- report on emissions produced based on benchmarks (e.g. standard XP D90-300-3)
- the relevant testing protocol (equipment and physical parameters)
- reports confirming the results declared.
In addition, all new recipes will have to be declared 6 months before they are potentially placed on the market.

MSDS
A product’s MSDS (Material Safety Data Sheet) is a mandatory document containing the list of hazardous molecules (flammable or explosive) and potential allergens contained in the product.
It is a product’s true ID document issued by an e-liquid supplier or manufacturer at the simple request of any third party.
There are several sections in an MSDS dealing with:
- the potential hazards of the product,
- labelling,
- the molecules it contains,
- the safety rules to be observed,
- storage conditions.
An MSDS is used to check product labelling:

INRS DECLARATION
Any manufacturer, reseller or importer of chemical products in Europe (including nicotine-free or flavourless e-liquids) is required to declare its products to an accredited body such as the INRS (French National Institute for Research and Safety).
This declaration must include:
- The chemical substance declaration form as well as their concentration in percentage,
- The MSDS (Material Safety Data Sheets) for all products used in the liquids,
- The labels of all declared trade names,
- A company letterhead specifying the trade name of each product declared.
